El fiscal superior de Extremadura también da traslado a la denuncia recibida contra Rocha

Mientras el presidente del Consejo Superior de Deportes (CSD), José Manuel Rodríguez Uribes, no se decide a suspender cautelarmente al recientemente nombrado presidente de la Real Federación Española de Fútbol (RFEF), Pedro Rocha, al extremeño no solo le persigue la sombra de Luis Rubiales, junto al que está imputado en el llamado caso Brody, sino también su propio pasado.

"Por si fuera de interés investigar, pongo en su conocimiento unos hechos, cuando menos irregulares, denunciados en su día tanto en la Federación Extremeña de Fútbol (FEXF) como en la RFEF y que, sorprendentemente, aún no han sido aclarados por ninguna de ambas instituciones". Al igual que hiciera ante el CSD, Miguel Galán remitió a la Fiscalía de Extremadura la denuncia anónima que recibió contra el ya proclamado presidente de la RFEF y antes de la FEXF, Pedro Rocha.

Una denuncia en relación con un contrato de ejecución de una obra para la adecuación y reforma de la visera del graderío del campo de fútbol Eusebio Bejarano, de Badajoz, que tal y como informamos en este diario, el CSD trasladó dicha denuncia a sus departamentos de régimen jurídico y control económico para su verificación. Ahora ha sido el fiscal superior de Extremadura, Francisco Javier Montero Juanes, quien ha acordado remitir la denuncia a la Fiscalía Provincial de Badajoz.

"El 9 de abril se incoó el expediente gubernativo 14/2024 a raíz de la recepción de correos remitidos por Miguel Galán", puede leerse en su decreto de remisión. Según siempre la denuncia trasladada por el presidente de Centro Nacional de Formación de Entrenadores (CENAFE), la cual fuentes de la FEXF aseguran que no se ajusta a la realidad, dicha federación, en nombre de la RFEF, formalizó en diciembre de 2019 un contrato con Coarrugados García Almendralejo SL. La empresa de Cáceres, a la que encargó la realización de la mencionada obra, de acuerdo con el proyecto redactado en noviembre de 2019 por el arquitecto Pablo Matilla Pérez.

Una obra con fondos provenientes del CSD

El presupuesto de ejecución material fue de 182.461 euros y se acordó que el precio definitivo sería el que resultase de multiplicar los precios unitarios del proyecto por las unidades de obra realmente ejecutadas según medición final. Igualmente, toda vez que el coste debía ser sufragado con fondos públicos provenientes del CSD, se acordó de manera expresa la imposibilidad de cualquier revisión o variación de dimensiones, calidad o precios unitarios presupuestados.

Sin embargo, una vez finalizada la obra, el contratista pasó al cobro de una factura/liquidación por el importe de presupuestado y contemplado en el proyecto de ejecución. Es decir, por 182.461 euros, pese a que la obra realmente ejecutada fue bastante menor, por lo que, una vez aplicados los precios unitarios acordados a las mediciones de la obra realmente ejecutada, el importe de la factura debía haber ascendido únicamente a 121.108 euros.

Es decir, se pretendía cobrar una factura con un exceso de más de 60.000 euros, de ahí que los responsables de las áreas de economía e infraestructuras e instalaciones de la FEXF se opusieron al pago. "Ante esta situación, el entonces vicepresidente económico de la FEXF, Francisco Santibáñez, trató el asunto con el secretario general de la RFEF, Andreu Camps, y se llegó a la conclusión de que, lógicamente, no se podría abonar la referida factura-liquidación emitida por el constructor —al no haber ejecutado toda la obra que facturaba— ni se podía tramitar el expediente ante el CSD por culpa de esas irregularidades".

Se pagaron 60.000 euros de más

Sin embargo, "a pesar de ello, pasados varios meses y sin consentimiento ni conocimiento de los responsables de economía e infraestructuras, se pagó íntegramente la factura emitida, incluida la demasía de más de 60.000 euros por obras que no había ejecutado. Esta grave irregularidad fue puesta en conocimiento del presidente de la FEXF, Pedro Rocha —aunque en ese momento estaba al frente de una comisión gestora—, el tesorero, Mario Cáceres, el secretario general, Sergio Merchán, e, incluso, el secretario general de la RFEF, Andreu Camps, a quienes se les pidió infructuosamente que depurasen responsabilidades y reclamasen la devolución de las cantidades indebidamente pagadas".

Llegados a este punto, el fiscal superior de Extremadura considera que "del relato de hechos puesto de manifiesto, y sin entrar en el fondo del asunto, se deduce que se refieren a la adecuación y reforma de la visera del graderío de los campos de fútbol Eusebio Bejarano de Badajoz, complejo deportivo La Granadilla. Es decir, está perfectamente determinado el lugar en que han producido: la ciudad de Badajoz".

En segundo lugar, apunta que "no consta la existencia de personas aforadas ante el Tribunal Superior de Justicia de Extremadura y que tengan algún tipo de implicación en los referidos hechos". Y, en tercer lugar, recuerda que "la actividad extra procesal del ministerio fiscal en el ámbito de la investigación penal, señala que la asunción por parte del fiscal superior de la tramitación de unas diligencias de investigación será excepcional".

Por último, indica que "si no se asume la investigación y se acuerda la remisión a la fiscalía que aparezca como competente, se incoará expediente gubernativo y se remitirán las actuaciones a ese órgano fiscal. En este caso, la competencia territorial está perfectamente fijada, en tanto en cuanto los hechos han ocurrido en la ciudad de Badajoz; no existen personas aforadas y el asunto no tiene las características que hagan aconsejable que el Fiscal Superior asuma la investigación". De ahí su decisión, con fecha 11 de abril, de "remitir las actuaciones a la Fiscalía Provincial de Badajoz".
